Queens Rideshare Landscape

Queens Has More Rideshare
Activity Than Almost Any Borough.

JFK Airport, LaGuardia Airport, Citi Field, and dense residential areas across the borough generate enormous rideshare volume. More rideshare activity means more accidents — and more $1M policies in play.

✈️

JFK & LaGuardia Airport Pickups

JFK and LaGuardia are among the busiest rideshare pickup and dropoff locations in the world. Accidents in the airport loop roads, on the Van Wyck approach to JFK, and on the Grand Central Parkway near LaGuardia all involve the full $1M commercial policy when the driver has an active trip.

💵

The $1M Policy Explained

When an Uber or Lyft driver has accepted a ride request (Period 2) or has a passenger in the vehicle (Period 3), the rideshare company provides up to $1,000,000 in commercial liability coverage. This policy covers passengers, pedestrians, cyclists, and occupants of other vehicles. It does not matter if the driver is an independent contractor — this policy is in play.

📱

Period 1 — App On, No Ride

When the app is on but the driver has not yet accepted a ride, the rideshare company provides limited contingent coverage — $50,000 per person, $100,000 per accident. This is less than the $1M, but still additional coverage on top of the driver's personal policy. We maximize recovery from all available sources.

🛣️

Queens Major Corridors

The Van Wyck Expressway, Queens Boulevard, Northern Boulevard, and Jamaica Avenue are all high-volume rideshare corridors. Accidents on these roads during active trips trigger the full $1M commercial policy immediately. We identify the period of service from app data subpoenaed in discovery.

🔍

Trip Data as Evidence

Uber and Lyft maintain detailed records of every trip — GPS data, speed, acceptance status, and timestamps. This trip data establishes which period of service was active at the time of your accident, which determines which insurance policy applies. We subpoena this data in every rideshare case.

⚖️

Multi-Party Claims

Queens rideshare accidents often involve multiple potential defendants — the driver, the rideshare company, other vehicles, and sometimes government entities if road conditions contributed. We identify and pursue every available source of recovery simultaneously.

Who Is Covered

Passengers, Pedestrians,
Cyclists — Everyone Is Protected.

The $1M Uber and Lyft commercial policy covers everyone hurt by a rideshare driver during an active trip — not just passengers. If an Uber driver ran a red light and struck you while you were in a crosswalk in Flushing, you have access to that $1M policy. If a Lyft driver swerved into your bike lane in Astoria, you have access to that policy. The coverage follows the rideshare vehicle, not the victim.

Identifying which period of service was active requires analyzing the driver's app data — specifically whether a trip had been accepted and whether a passenger was in the vehicle. Uber and Lyft maintain this data and we subpoena it in every case. Insurance companies will not volunteer which policy applies. We force the issue.

✈️ JFK Airport Rideshare Accidents

Accidents at JFK Airport involve both the Uber/Lyft commercial policy AND potential Port Authority of New York and New Jersey liability for road and terminal conditions. Port Authority claims have very short Notice of Claim deadlines — call us immediately after any JFK area rideshare accident.

Queens is also home to many Uber and Lyft drivers — residents of Jackson Heights, Corona, Jamaica, and other neighborhoods who drive for rideshare as their primary income. We understand the insurance framework from both the victim and driver perspectives, which helps us navigate multi-party Queens rideshare claims efficiently.

What To Do Right Now

Hurt in a Queens Rideshare Accident?

1

Screenshot Everything

Screenshot the trip in the Uber or Lyft app immediately — driver name, photo, vehicle, and trip details. This data can disappear.

2

Get Medical Care

Go to the ER immediately. No-fault PIP benefits cover medical expenses regardless of fault — but you need same-day documentation.

3

Report to the App

Report the accident through the Uber or Lyft app. This creates a timestamp record and triggers the insurance claim process.

4

Call Before Accepting Any Offer

Uber and Lyft insurers will move fast with low settlement offers. Call us before accepting anything — that $1M policy has room to negotiate.

FAQ

Queens Rideshare Questions

How do I know which insurance policy applies to my Queens rideshare accident?

It depends on which period of service the driver was in at the time of the accident. Period 0 (app off) — driver personal insurance only. Period 1 (app on, no ride accepted) — limited contingent coverage from Uber/Lyft. Period 2-3 (ride accepted or passenger in vehicle) — full $1M commercial policy. We determine this from the driver app data.

The Uber driver who hit me says he was off-duty. What do I do?

Whether the driver was truly off-duty or had the app on is determined by the Uber or Lyft records, not the drivers word. We subpoena the app data which contains timestamps and status records. Many drivers who claim to be off-duty were actually in Period 1 or Period 2 coverage, making the company policy available.

I was injured in an Uber on the way to JFK. What are my options?

As a passenger in an active Uber trip, you are covered by the full $1M commercial policy. If the accident was on roads near JFK or within the airport campus, there may also be Port Authority liability to consider. Port Authority claims have very short Notice of Claim deadlines — call us immediately regardless of where you are in your recovery.

Can I sue Uber or Lyft directly?

Direct lawsuits against Uber or Lyft are possible but difficult because drivers are classified as independent contractors. The more practical and effective approach is to pursue the $1M commercial insurance policy that Uber and Lyft are required to maintain — that policy covers your damages regardless of whether you can sue the company directly. In cases of negligent hiring or pattern-of-safety violations, direct claims against the company are also pursued.
