The Bronx and Rent Stabilization

The Bronx has the highest percentage of rent-stabilized apartments of any NYC borough. Buildings with 6 or more units built before 1974 are likely stabilized. Check HCR.ny.gov for your building. If your rent exceeds the legal registered amount, you may have an overcharge claim.

Rent Overcharge — Treble Damages

Bronx landlords overcharging rent-stabilized tenants face refund orders going back years — and if the overcharge was willful, courts award treble damages (three times the overcharged amount). The New York's tenant-protection law 2019 eliminated most deregulation loopholes that Bronx landlords previously exploited.

How do I find out if my Bronx apartment is rent stabilized?

Go to HCR.ny.gov and use the Apartment Lookup feature. Enter your Bronx address and you will see whether your building is registered as rent stabilized and what the legal regulated rent history shows. If your building is stabilized and you are paying more than the registered rent, call us immediately.

My Bronx landlord has not fixed a serious leak for three months. What can I do?

File an HP Action in Bronx Housing Court at 1118 Grand Concourse. An HP Action is an emergency court proceeding that can compel your landlord to make repairs within days of the order. We file HP Actions regularly in Bronx Housing Court and can often get hearings scheduled quickly.

My landlord says my apartment is deregulated. Is that possible?

Under the tenant-protection law 2019, it is significantly harder for Bronx landlords to deregulate stabilized apartments. The vacancy decontrol threshold was raised substantially, and high-rent deregulation was effectively eliminated. If your landlord claims deregulation, we will verify it against the DHCR registration records. Many so-called deregulations in the Bronx are invalid.

NYCHA is refusing to fix dangerous conditions in my apartment. What are my options?

NYCHA tenants have rights under both New York State law and federal housing regulations. You can file an HP Action in Bronx Housing Court against NYCHA to compel repairs.
