What you need to know

3-year statute of limitations.

NY personal-injury claims must be filed within 3 years (New York civil procedure rule 214). For wrongful death: 2 years from date of death.

No no-fault for motorcyclists.

NY no-fault law excludes motorcyclists from no-fault PIP coverage. That's bad for medical billing but good for your damages claim — no serious-injury threshold to overcome.

Helmet use is not contributory negligence.
