NYC Postmates Accident Lawyer · Riders, Drivers & Pedestrians · Now Backed by Uber Eats Coverage

Hit by — or hurt while delivering for — Postmates in NYC?

We represent both sides of Postmates accidents: pedestrians, cyclists, and motorists struck by a Postmates driver; AND delivery workers injured while delivering for Postmates. Postmates was acquired by Uber in 2020 and the standalone app was sunset in 2022 — every Postmates-branded delivery in NYC today is operationally an Uber Eats delivery, with Uber's $1M active-delivery commercial coverage. We handle current cases under Uber's policies AND legacy Postmates cases still in litigation. Free consultation. No immigration questions. We come to you.

How we handle your case

1

Identify the platform

First we determine which platform's policy actually governs. For accidents before late 2022, Postmates may still be the named insured. For accidents after the merger, it's almost always Uber Eats. We send the right preservation letters to the right legal department — sending a Postmates-style demand to a case that's now Uber-controlled wastes weeks of valuable preservation window.

2

Stack the coverage

If you were HIT by a Postmates / Uber Eats driver: we pursue the platform's $1M contingent commercial policy + the driver's personal auto + your own UM/UIM. If you were HURT WHILE DELIVERING: we pursue the at-fault third-party driver's auto policy + the platform's occupational accident coverage + your own UM/UIM + (if you're a W-2 employee) workers' comp. Either way, multiple recovery sources usually stack.

3

Try

Postmates cases typically name both the driver and the platform as defendants. The contractor-classification fight is window dressing — the active-delivery commercial policy responds regardless. We coordinate trial counsel where the case warrants under NY co-counsel rules.

What you can recover

Medical bills (past and future)
Lost wages and lost earning capacity
Pain and suffering
Property damage (your vehicle, bike, scooter)
Loss of life enjoyment
Wrongful death (if fatal)

Every case is different. The recoverable damages depend on your injuries, the insurance available, and the facts of your case.

What you need to know

If you were hit by a Postmates driver

Postmates is now functionally Uber Eats.

Uber acquired Postmates in December 2020 for $2.65B. The standalone Postmates app was discontinued in mid-2022. Every Postmates-branded delivery since is run on Uber's infrastructure with Uber's insurance. The brand still appears in some places (restaurant menus, partnership materials) but the policies you'd be claiming against are Uber's.

Active-delivery coverage stacks on personal auto.

Postmates / Uber Eats drivers carry their own personal auto insurance (primary). The platform carries a contingent commercial policy (excess, up to $1M) that activates during active delivery. This stacking can mean the difference between $25K/$50K minimum coverage and $1M+ total available coverage. Identifying the trip state at the moment of crash is critical.

If you were hurt while delivering for Postmates

Your immigration status does not matter.

By NYC law (Executive Order 41), police, EMS, and hospitals do not ask or share immigration status. We don't ask either. Federal courts have repeatedly confirmed undocumented workers can sue and recover damages for injuries on the job in NY. You have full access to the civil court system regardless of status.

Postmates couriers' recovery options now flow through Uber.

Since the 2022 merger, Postmates couriers are functionally Uber Eats couriers. As a 1099 contractor you generally don't get NY workers' comp — but you DO have: (a) a full third-party PI claim against the driver who hit you, (b) Uber's occupational accident coverage (medical + disability up to certain limits), and (c) your own UM/UIM. We pursue every available source.

Applies to both situations

Three-year statute of limitations.

In NY, most personal-injury claims must be filed within 3 years of the accident. Even though Postmates as a standalone brand is gone, the legal claims survive — the cause of action runs from the accident date, not from the merger date. Claims against NYC HHC facilities and MTA buses require a 90-day notice of claim. Don't wait.
