First we determine which platform's policy actually governs. For accidents before late 2022, Postmates may still be the named insured. For accidents after the merger, it's almost always Uber Eats. Uber acquired Postmates in December 2020 for $2.65B. The standalone Postmates app was discontinued in mid-2022. Every Postmates-branded delivery since is run on Uber's infrastructure with Uber's insurance. The brand still appears in some places (restaurant menus, partnership materials) but the policies you'd be claiming against are Uber's.
Postmates / Uber Eats drivers carry their own personal auto insurance (primary). The platform carries a contingent commercial policy (excess, up to $1M) that activates during active delivery. This stacking can mean the difference between $25K/$50K minimum coverage and $1M+ total available coverage. Identifying the trip state at the moment of crash is critical.
By NYC law (Executive Order 41), police, EMS, and hospitals do not ask or share immigration status. We don't ask either. Federal courts have repeatedly confirmed undocumented workers can sue and recover damages for injuries on the job in NY. You have full access to the civil court system regardless of status.
Since the 2022 merger, Postmates couriers are functionally Uber Eats couriers. As a 1099 contractor you generally don't get NY workers' comp — but you DO have: (a) a full third-party PI claim against the driver who hit you, (b) Uber's occupational accident coverage (medical + disability up to certain limits), and (c) your own UM/UIM. We pursue every available source.
In NY, most personal-injury claims must be filed within 3 years of the accident. Even though Postmates as a standalone brand is gone, the legal claims survive — the cause of action runs from the accident date, not from the merger date.
