NYC DoorDash Accident Lawyer · Riders, Drivers & Pedestrians · $1M Active-Delivery Coverage

Hit by — or hurt while dashing for — DoorDash in NYC?

We represent both sides of DoorDash accidents: pedestrians, cyclists, and motorists struck by a DoorDash driver; AND dashers injured while delivering. During an active delivery, DoorDash's contingent commercial policy (up to $1M) stacks on top of the dasher's personal auto policy. Whether the dasher was on the way to pick up, returning empty, or off-app entirely changes which coverage applies — and we know how to find out. Free consultation. No immigration questions. We come to you.

How we handle your case

1

Investigate

Preservation letters within days to DoorDash for trip data, GPS, app-event logs, and the dasher's delivery status at the moment of impact. Police report. Witness statements from the customer (if any) about whether food was being delivered. Dashcam from nearby vehicles. We move fast — DoorDash preserves trip data on a schedule, and waiting can mean losing critical evidence. Same investigation playbook whether you're the victim or the dasher.

2

Stack the coverage

If you were HIT by a DoorDash driver: we pursue DoorDash's $1M+ contingent commercial policy + the dasher's personal auto + your own UM/UIM if the dasher was underinsured. If you were HURT WHILE DASHING: we pursue the at-fault third-party driver's auto policy + DoorDash's occupational accident coverage + your own UM/UIM + (if you're a W-2 employee somewhere) workers' comp. Either way, multiple recovery sources usually stack.

3

Try

Like rideshare, DoorDash cases name BOTH the dasher and the platform. DoorDash aggressively litigates the 'independent contractor' defense, but the active-delivery commercial policy is the real target — that policy responds regardless. We coordinate trial counsel where the case warrants under NY co-counsel rules.

What you can recover

Medical bills (past and future)
Lost wages and lost earning capacity
Pain and suffering
Property damage (your vehicle, bike, scooter)
Loss of life enjoyment
Wrongful death (if fatal)

Every case is different. The recoverable damages depend on your injuries, the insurance available, and the facts of your case.

What you need to know

If you were hit by a DoorDash driver

Active-delivery coverage stacks on personal auto.

DoorDash, Uber Eats, and Grubhub all carry contingent commercial liability policies (typically $1M+) that activate when a driver is on an active delivery. The driver's personal auto policy is primary; the platform's policy is excess. This stacking can mean the difference between $25K/$50K minimum coverage and $1M+ total available coverage. Identifying the trip state at the crash moment is critical.

Period of delivery matters.

DoorDash's coverage is tiered like Uber/Lyft rideshare. Period 1 (logged in but no order accepted): platform contributes limited contingent liability if at all. Period 2 (en route to pickup) and Period 3 (food in hand, en route to drop-off): the platform's full $1M+ contingent commercial policy activates. Trip-state preservation evidence is critical.

If you were hurt while delivering for DoorDash

Your immigration status does not matter.

By NYC law (Executive Order 41), police, EMS, and hospitals do not ask or share immigration status. We don't ask either. Federal courts have repeatedly confirmed undocumented workers can sue and recover damages for injuries on the job in NY. You have full access to the civil court system regardless of status.

As a DoorDash dasher you have multiple recovery paths.

DoorDash classifies dashers as 1099 contractors, so you generally don't get NY workers' comp — but you DO have: (a) a full third-party PI claim against the driver who hit you, (b) DoorDash's occupational accident coverage (medical + disability up to certain limits, kicks in during active deliveries), and (c) your own UM/UIM if you have personal auto. We pursue every available bucket.

Applies to both situations

Three-year statute of limitations.

In NY, most personal-injury claims must be filed within 3 years of the accident. Claims against NYC Health + Hospitals (HHC) facilities — Bellevue, Elmhurst, Kings County, Lincoln, etc. — and MTA buses require a 90-day notice of claim. Don't wait.
